New Laws Increase Limits on Workers’ Compensation Benefits

Increased Benefits for Specific Types of Workers Comp Cases

Most injuries at work include the first two as you’re likely to miss some time at work and have medical bills. However, when a work-related injury limits your ability to work going forward, you should qualify for disability benefits through the work comp provider. The changes to Minnesota Work Comp laws apply to this third category of disability compensation.

If you were hurt at work after October 1st, 2018, the newly increased limits for disability payments will be available to you. There are three types of disability payments which have recently changed:

Temporary Partial Disability Benefits 

You are eligible for temporary partial disability benefits (TPD) when you are earning a lower wage as a result of your injury. These benefits used to be available for a maximum of 225 weeks, and that has now been raised to 275 weeks.

Permanent Partial Disability 

Permanent Partial Disability, or PPD is compensation paid to a worker who has sustained a ratable, permanent injury or impairment under the work comp disability payment schedule. The payment amounts for injured workers receiving PPD have been increased.

Permanent Total Disability (PTD) Retirement Presumption

For people who have sustained a work injury that resulted in TOTAL disability, the assumed retirement age had been 67. Now, injured workers receiving PTD are eligible to receive payments until they are 72 years old.
